Wright Hip Lawsuit News: Federal Judge Allows Punitive Damage, Fraud Claims to Stand in Wright Profemur Hip Implant Claim, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) August 19, 2014 -- A federal judge overseeing a Wright hip lawsuit (http://www.consumerinjurylawyers.com/wright-profemur-hip-replacement) involving the Profemur hip replacement has refused to dismiss the Plaintiffs’ claims for fraud and punitive damages, Bernstein Liebhard LLP reports. According to an Order filed on July 23rd in the U.S. District Court, Central District of California, Judge Christina A. Snyder found that the Plaintiffs’ allegations that Wright Medical failed to disclose reports of Profemur neck fractures while it was also boasting of a near-perfect safety record were sufficient to allow the fraud claims to proceed. The Plaintiffs’ will also be able to pursue punitive damages against Wright Medical Technology, Inc., as they were predicated on the fraud claims. (Shimy, et al. v. According to court documents, the Wright hip lawsuit was filed on behalf of a Profemur hip recipient who allegedly experienced the fracture of his hip replacement five years after the device was implanted.

According to a recent regulatory filing, Wright Medical is currently named a defendant in at least 36 lawsuits involving the Profemur hip replacement.* Court documents indicate that the company has also reached settlements in a small number of claims, including one Profemur lawsuit that was set to go to trial in the U.S. District Court, Middle District of Georgia last December. Court records also indicate that Wright Medical is facing a number of lawsuits involving its Conserve hip replacement line, all of which allege that the metal-on-metal devices caused recipients to suffer metallosis, pseudotumor formation, failure of the hip, and other serious complications that often result in a need to surgically remove and replace the hip implant. The majority of these cases are now pending in a multidistrict litigation underway in U.S. District Court, Northern District of Georgia, where at least 397 claims have been filed.
