A Wright Profemur hip lawsuit was settled out of court last month, according to recently released court documents. The Rottenstein Law Group LLP, which represents clients in Wright hip lawsuits, notes that Wright Medical is currently a defendant in lawsuits for two different hip implant product lines, the Profemur Z and the Conserve Plus.
The suit was to be tried in federal court in Georgia, but was settled on Nov. 7, days before the trial was to begin, according to court documents (Timothy R. Courson, et al., vs. Wright Medical Technology, Inc.; Case No. 5:12‐cv‐173, U.S. District Court for the Middle District of Georgia). Details of the settlement were not disclosed.
“Settlement details often are not disclosed,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “A plaintiff might choose settlement over a trial for any of several reasons. Typically, the greatest benefit of a settlement is the certainty of the outcome.”
This news comes at a time when DePuy Orthopaedics has agreed to a multibillion settlement over the company’s ASR hip implant, a product similar to the Profemur, according to a Nov. 20 New York Times story.*
