Utah Personal Injury Lawyer Peter Summerill Wins $1.6M Verdict Against Intermountain Healthcare in Wrongful Death Case

A jury found IHC, Utah’s largest healthcare network provider, liable for medical malpractice in the drug overdose of a patient represented by Summerill, according to a report in the Standard Examiner of Ogden, Utah. (“Wrongful-death verdict goes against Intermountain Healthcare,” Oct. 29, 2014)
IHC North Odgen Clinic and Pharmacy were providing treatment for chronic pain to a patient, according to the pleadings of the lawsuit.* The treatment involved a large number of pain killers, sedatives and sleep medications, up to 33 pills per day, according to the lawsuit.
The patient went to bed on April 2, 2008, and his wife discovered him not breathing and unresponsive the next morning, the lawsuit states.
A lawsuit was brought alleging that the mix of medications and accumulations of drugs given by IHC caused the death.
On Oct. 27, a jury returned a verdict in the amount of $1,676,737 against IHC for the wrongful death of the patient.
According to the Standard Examiner, the jury in 2nd District Court heard eight days of testimony before returning the verdict in the wrongful death trial.
The article states that IHC owns more than 20 hospitals and other facilities in Utah. The Standard Examiner reported that Summerill filed the lawsuit in September 2010. The attorneys obtained more than 400 pages from IHC about their client’s long-term care, the article stated.
According to the lawsuit, the pills taken by the patient, Randy Krambule, “metabolized and accumulated in (the patient), leading to and causing a combined drug toxicity which resulted in death.”
“No amount of money will bring back Mr. Krambule, but this verdict demonstrates the significant loss that his family experienced,” Summerill said. “We believe this verdict can help the family get closure and sets the record straight about what happened to Mr. Krambule.”
