Defendants in more than a dozen Xarelto lawsuits (http://www.xareltolawsuitcenter.com) currently pending in Pennsylvania’s Philadelphia Court of Common Pleas are attempting to have all claims filed on behalf of out-of-state plaintiffs dismissed, Bernstein Liebhard LLP reports. According to motions filed on September 11th, the defendants maintain that circumstances surrounding the alleged injuries and other claims contained in the lawsuits have no connection to Pennsylvania. The filings did indicate that the defendants were amendable to jurisdiction in the plaintiffs’ home states should they ultimately refile their cases there. (Case No. 140304328)

According to court documents, all of the Xarelto lawsuits pending in Philadelphia allege that the manufacturers of the drug failed to provide adequate warnings regarding its association with uncontrollable internal bleeding, particularly the lack of an approved antidote for this occurrence. They further claim that Xarelto was wrongly marketed as a superior alternative to warfarin, a blood thinner that has been on the market for decades. The complaints point out that warfarin bleeding can be reversed via the administration of vitamin K.
Xarelto was launched in the U.S. in 2011, and is now approved to prevent strokes in people with atrial fibrillation; as a treatment for deep vein thrombosis and pulmonary embolism; and to prevent deep vein thrombosis in patients undergoing hip or knee replacement surgery. *
In May, the Institute of Safe Medicine Practices revealed that the U.S. Food & Drug Administration had received a total of 680 Xarelto adverse event reports in the first quarter of 2013. For the first time, reports of complications associated with the medication outpaced those associated with Pradaxa, another blood thinner in the same class, according to the ISMP.**
