Xarelto Lawsuit Plaintiffs File Briefs In Support of Federal Consolidation, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) November 26, 2014 -- As Xarelto lawsuits (http://www.xareltolawsuit2015.com/) continue to mount in U.S. courts, Bernstein Liebhard LLP notes that plaintiffs involved in these cases have filed a number of briefs with the U.S. Judicial Panel on Multidistrict Litigation (JPML) that support the creation of a multidistrict litigation for all federally-filed claims that allege the blood thinner caused dangerous internal bleeding and related side effects. In one such brief filed with the Panel on November 21st, an Alabama plaintiff asserts that the consolidation of the federal Xarelto docket is appropriate because, among other things, all of the lawsuits involve identical questions of law and fact that arise from the same course of conduct. The November 21st brief also supports the assertion that the U.S. District Court, Southern District of Illinois, is the best venue for the proposed Xarelto litigation, noting that U.S. District Judge David Herndon has experience presiding over other complex litigations, including the federal proceeding involving Pradaxa, another blood thinner in the same class as Xarelto. The brief argues that Xarelto lawsuits will likely involve many of the same legal questions that were at issue in the Pradaxa cases.

Court records indicate that at least 30 Xarelto lawsuits have been filed in U.S. courts on behalf of individuals who suffered uncontrollable bleeding and other serious complications allegedly linked to its use. According to the original Motion for Transfer filed with the JPML in October, plaintiffs assert that the manufacturers of Xarelto concealed its serious risks, and wrongly marketed the drug as a superior alternative to warfarin, a blood thinner that has been on the market for decades. Among other things, the lawsuits point out that internal hemorrhaging sometimes seen among warfarin patients can be stopped via the administration of vitamin K. However, there currently exists no approved antidote to stop Xarelto bleeding.
According to a Hearing Session Order issued by the JPML on October 22nd, Oral Arguments on the proposed Xarelto multidistrict litigation will be heard on December 4th in Charleston, South Carolina. If the Panel decides to consolidate federally-filed Xarelto lawsuits, pending and future claims will be transferred to a single federal judge for coordinated pretrial proceedings, including discovery and motions practice. Such proceedings allow for more efficient prosecution of product liability lawsuits that involve common questions of fact, and help to preserve the resources of the court, parties and witnesses involved in the litigation.
