Federal Xarelto Lawsuits Headed to Multidistrict Litigation in Louisiana, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) December 15, 2014 -- The U.S. Judicial Panel on Multidistrict Litigation has decided to centralize all federally-filed Xarelto lawsuits (http://www.xareltolawsuit2015.com/) in a single proceeding to be established in the U.S. District Court, Eastern District of Louisiana, Bernstein Liebhard LLP reports. According to a Transfer Order issued by the Panel on December 12th, at least 21 Xarelto cases have been filed in federal courts that allege the medication caused plaintiffs to experience dangerous internal bleeding and other serious complications. While the JPML acknowledged that the pending lawsuits did “present a number of individualized factual issues,” the members found that the docket would benefit from centralization because plaintiffs also raise numerous common issues, “including the adequacy of Xarelto’s warning label as to the risk of severe bleeding, the results of certain clinical studies, and the alleged need for blood monitoring.” (In Re: Xarelto (Rivaroxaban) Products Liability Litigation, MDL No. 2592)

According to court documents, all of the Xarelto lawsuits currently pending in federal court allege that the drug’s manufacturers wrongly marketed it as a superior alternative to warfarin. Among other things, the complaints point out that there currently exists no approved antidote to reverse Xarelto bleeding, while the internal bleeding that may sometime occur with warfarin can be stopped via the administration of vitamin K. The lawsuits also claim that the drug makers should have recommended blood monitoring for Xarelto patients, so that physicians could adjust dosage to avoid high concentrations that have the potential to lead to life-threatening internal hemorrhaging.
In October, a number of Xarelto plaintiffs petitioned the JPML for consolidation of all federally-filed claims, asserting that thousands of additional cases would eventually be filed by individuals who were allegedly harmed by the medication. Consolidation of the Xarelto docket will allow the cases to undergo coordinated pretrial proceedings, thereby avoiding duplicative discovery and inconsistent court rulings. The establishment of the multidistrict litigation will also preserve the resources of the Court, parties and witnesses.
