The federal court overseeing Xarelto lawsuits (http://www.xareltolawsuit2015.com/) that allege the blood thinner caused life-threatening episodes of internal bleeding and other complications has outlined a leadership structure for the proceeding, Bernstein Liebhard LLP reports. According to an Order dated December 17th, the Court plans to select lawyers to serve as Liaison Counsel for the parties and also plans on appointing a Plaintiffs’ Steering Committee, which will coordinate the discovery stage of the litigation with the defendants’ representatives or committees. Xarelto Lawsuit Allegations
The Xarelto litigation was established less than a month ago, via a Transfer Order issued by the U.S. Judicial Panel on Multidistrict Litigation on December 12th. As such, all Xarelto lawsuits now pending in federal courts, as well as those filed in the future will be transferred to the Eastern District of Louisiana for coordinated pretrial proceedings. This type of multidistrict litigation is established when a large number of lawsuits that put forth similar questions of fact are expected to be filed. Such proceedings are designed to conserve the resources of the court, parties and witnesses by avoiding duplicative discovery and inconsistent rulings across the docket.
According to court documents, all of the Xarelto lawsuits pending in the Eastern District of Louisiana similarly accuse the drug’s manufacturers of failing to provide adequate warnings about its risks. Among other things, plaintiffs charge that Xarelto was wrongfully promoted as a superior alternative to warfarin, a blood thinner that has been in use for decades. They point out that while there is currently no approved antidote to reverse Xarelto bleeding, hemorrhaging associated with warfarin can be stopped via the administration of Vitamin K. The lawsuits also contend that Xarelto patients would benefit from regular blood monitoring, despite marketing claims that such testing is not necessary.
