The case in question is a civil action that was filed in U.S. District Court in Alabama this year by Julie Hunter on behalf of herself and her child, Talon. Talon Hunter was born in 2006 with multiple birth defects including heart defects, physical deformities, and long term health problems which the plaintiff alleges are linked to her ingestion of Zofran during pregnancy, according to court documents. Ms. Hunter took Zofran when it was prescribed by her doctor to treat morning sickness during her pregnancy and alleges she was not warned about the potential for a heightened risk of birth defects, according to court documents. This Zofran lawsuit alleges that GlaxoSmithKline, the maker of Zofran, knew or should have known of the alleged risks of birth defects linked to the drug, according to court documents.

This particular Zofran lawsuit is among the first lodged against GlaxoSmithKline by a mother on behalf of her child, alleging the drug caused the child to develop birth defects. But court documents for this case recount other litigation the company has faced for Zofran and its use to treat morning sickness.** The safety of Zofran for developing fetuses and pregnant mothers was addressed by a high-profile lawsuit filed by the Department of Justice in 2013. GSK paid approximately $3 billion in settlements to resolve charges that include the promotion of Zofran for off-label uses, according to court documents from the DOJ case.
