ALCU Challenges New Law That Targets Drug Addicted Mothers

Proponents of the bill, which went into effect at the beginning of July, believe that the bill allows all children to have an equal opportunity in life. Those who oppose the bill believes it discourages women from getting help or medical treatment for their addiction in fear that they will get in trouble. They pointed out that the two biggest rehab centers in the state make it difficult for women of low-income to get help. Additionally, the ALCU is pushing to fight the bill under the argument that it violates woman’s right to privacy.
Representatives of the ALCU believes that the Supreme Court will agree with their argument, as that jurisdiction of the law does not make it criminal to be a drug addict. Currently under the new law, one woman has been arrested and charged with assault because her child was born addicted to meth. She currently faces up to a year in jail and a minimum $2,500 fine. Opponents of the bill do not believe that the penalties of the law alone will deter women from being drug addicts. Instead, they hope to change the law so that it offers more help instead of leaving women hindered.
