Transvaginal Mesh Lawsuit News: Bernstein Liebhard LLP Notes New Order in American Medical Systems Multidistrict Litigation

According to an Order dated July 16th, the parties have agreed to stipulations governing the deposition of American Medical Systems’ witnesses, including employees and former employees of the company, its parent or affiliates. Transvaginal Mesh Lawsuits
Court documents show that more than 7,700 transvaginal mesh lawsuits have been filed against American Medical Systems in the federal litigation. According to an Order issued by the Court on July 1st, four cases have been selected for the litigation’s bellwether trials, with the first scheduled to begin in December.
Separate multidistrict litigations are also underway in the Southern District of West Virginia for claims involving other mesh manufacturers, including: Boston Scientific Corp., (MDL No. 2326); C.R. Bard, Inc., (MDL No. 2187), and Ethicon, Inc. (MDL No. 2327). Bernstein Liebhard LLP partner, Jeffrey S. Grand, is also serving on the Plaintiffs’ Steering Committees for these proceedings.
Transvaginal mesh is used to surgically treat pelvic organ prolapse and stress urinary incontinence. In October 2008, the U.S. Food & Drug Administration (FDA) warned the public that it had received more than 1,000 reports of serious complications associated such devices over a three year period.* In July 2011, the FDA warned that vaginal mesh complications associated with prolapse repair had grown five-fold since its previous alert, and stated that it no longer considered these types of injuries to be rare.**
Hundreds of transvaginal mesh lawsuits have also been filed in state courts throughout the country. Mr. Grand is serving as Co-Liaison Counsel in two consolidated litigations established for C.R. Bard and Ethicon transvaginal mesh lawsuits that are currently underway in New Jersey’s Atlantic County Superior Court. He was also a member of the trial team on the first Ethicon trial in that proceeding, which ended in March with an $11 million verdict for the Plaintiff.
