Bard Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2187; and In re: Ethicon, Inc. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327.

Vaginal Mesh Lawsuits
Court documents indicate that more than 20,000 claims have been filed in the Southern District of West Virginia on behalf of women who suffered serious vaginal mesh complications following transvaginal implantation of surgical mesh to treat pelvic organ prolapse or stress urinary incontinence. Since 2008, the U.S. Food & Drug Administration (FDA) has issued two public health alerts regarding the high rate of injuries associated with transvaginal mesh. According to the agency, serious vaginal mesh complications following surgery to repair pelvic organ prolapse are not rare, and it is not clear that the use of such devices is any more effective in treating the condition than traditional non-mesh procedures.
On August 15th, the federal litigation’s first trial of a transvaginal mesh lawsuit concluded with the jury awarding $2 million in compensatory and punitive damages to a woman who was injured by C.R. Bard’s Avaulta Plus device. (Cisson v. C.R. Bard Inc., 11-cv-00195) The litigation’s second C.R. Bard trial was to commence the following week, but the case settled the same day opening arguments were to be delivered. Terms of the vaginal mesh settlement have not been disclosed. (Queen v. C.R. In addition to the federal claims, thousands of transvaginal mesh lawsuits involving products marketed by C.R. Bard and Ethicon are pending in two consolidated litigations underway in New Jersey’s Atlantic County Superior Court. Bernstein Liebhard LLP partner, Jeffrey S.
