Wilmington, NC Personal Injury Attorney Richard Flexner Comments on North Carolina Move Over Law
Wilmington, NC (PRWEB) December 01, 2013 -- A recent news story about a New Hanover County car accident involving a drunk driver who struck a tow truck company employee stopped at the side of the road serves as a tragic reminder that drunk driving and failing to abide by North Carolina Move Over Laws can have deadly consequences, says Richard Flexner of the Law Offices of Richard Flexner, a drunk driving accident lawyer in Wilmington, NC.
According to NBC 6 (“Man with 8 prior DWI convictions pleaded guilty to second degree murder,” November 4), a drunk driver failed to abide by the state’s Move Over Law in a 2012 accident. A tow truck company employee was stopped on the shoulder of the road to assist a driver when he was struck and killed, according to NBC 6.
“Our state’s Move Over Laws are designed to protect emergency medical personnel and public service vehicles with flashing lights that are stopped on the shoulder of a highway. Drivers are required to move over one lane, if possible, or reduce their speed while approaching one of these vehicles,” said Flexner, who represents victims of negligence and families who lost loved ones in car accidents.
NBC 6 said that the accident occurred on Carolina Beach Road in Wilmington. The drunk driver’s truck struck and killed a tow truck employee who was stopped at the side of the road to help a motorist change a flat tire, NBC 6 said.
In addition, according to NBC 6, the driver fled the scene of the accident and was stopped by state troopers nearly nine miles past the accident. Police said more than two hours after the crash his blood alcohol content was .26, more than three times the legal limit, according to NBC 6.
NBC 6 reported that the drunk driver, who had eight prior DWI convictions, was sentenced to 19 to 24 years in prison.
“While many people know that drunk driving is extremely dangerous, they might not realize that impaired judgment behind the wheel can lead to a number of bad and potentially deadly decisions. These include fleeing the scene of an accident, failing to observe the state’s Move Over Laws, and disobeying traffic signals such as stop signs and red lights,” said Flexner, a drunk driving accident attorney in Wilmington, NC.
Flexner said attorneys can help victims of drunk drivers pursue compensation for their losses. An attorney can hold the negligent individual – and sometimes the business that served that individual – accountable, he said.
