Connecticut Attorney Heath D. Harte Comments on Liability Questions Surrounding Disappearance of Malaysian Airlines Flight MH370

In a recent article in the ABA Journal (Potential liability for missing Malaysia Air flight depends, in part, on finding plane, 3/25/2014), it was noted that, since all passengers and crew from the missing flight are now presumed dead, Malaysian Airlines must pay approximately $175,000 for the death of each individual under an international agreement known as the Montreal Convention. The article notes that that total could increase if third party liability can be established, and individual compensation may vary based on the country of residence for each victim.
According to the ABA Journal article, the possible compensation for victims based in the United States could be as much as $10 million, while families of victims who lived in other countries could receive $1 million or less.
“While there is significantly more value for any claim that is filed in a court in the United States, most of the passengers on the flight were Chinese or Malaysian,” said Heath D. Harte. “Unless a link to the United States can be proven for any of the deceased, most of these claims are likely to be processed in China or Malaysia. Of course, the question of third party liability is still very much in dispute, and will remain that way until the plane can be located and a cause for the disappearance can be determined.”
