Number of Lawsuits Involving Defective Hip Implants Increasing Nationwide - McGartland Law Firm, PLLC
TULSA, Oklahoma (PRWEB) October 27, 2014 -- The McGartland Law Firm announced today that it is now accepting cases involving patients who alleged that they were injured as a result of either the Stryker Rejuvenate or ABG II hip implants that were manufactured by Stryker Orthopaedics. These defective hip implants proved to be very problematic for patients impacted by their failure.
There are thousands of lawsuits being filed nationwide; as of September 10, 2014, 2,097 of them were pending in Bergen County Superior Court in New Jersey alone (1). As a result of numerous complaints filed with the U.S. Food and Drug Administration (2), Stryker announced a voluntary recall on July 6, 2012 due to a high occurrence of corrosion and fretting near the neck junction of both the Rejuvenate and ABG II devices. The recall was issued after it was discovered that the implants were leeching cobalt and chromium, materials that can lead to metallosis, also referred to as metal poisoning. Other health problems reported by patients who had these defective hip implant devices implanted include:
• Deterioration of bones around the hip implant
• Swelling of tissues in and around the hip
• Severe pain
• Corrosion and fretting resulting in blood poisoning or 'metallosis'
• Necrosis - Premature decay of tissue
• The need for revision surgery as a result of the failed Stryker Hip Implant
Prior to the 2012 recall, about 20,000 implants had been worldwide. Even though the implants were failing at a high rate, the company informed doctors in promotional materials that testing had shown that the devices did not present a risk for corrosion and fretting (4). Many lawsuits against Stryker allege that the manufacturer negligently designed, manufactured and sold the devices, and also failed to properly warn doctors and patients of potential health issues.
In addition to the Stryker hip implant recall lawsuits being heard in New Jersey, more than 1,700 others have been filed in the U.S. District Court, District of Minnesota. (In re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, No. 244) Stryker settled four hip implant suits in December of 2013 (4). However, the amounts were not disclosed. Stryker has recommended that patients fitted with these implants get medical screening, whether or not they have suffered health issues that signify a problem has occurred.
