Stay Safe, Avoid Being Pulled Over This Thanksgiving

Local criminal defense attorney, Mark Thiessen, of the Thiessen Law Firm offers practical tips for revelers to consider this holiday season regarding safe driving practices and the appropriate way to handle being pulled over by police.

Don’t be in the dark when Black Friday arrives after Thanksgiving. Many Houstonians know that the Wednesday before Thanksgiving is a big night to reconnect with friends for the holiday. So it’s all about getting together over cocktails and conversation. Take these precautions to keep you out of trouble.

Avoid the possibility of being pulled over at all by following these 5 tips:
1. Plan ahead: call Uber or The Wave for a safe ride out and home.
2. Make sure your inspection and state registration are current, and all your lights are working properly.
3. If you valet park, check that your head lights are on when you get back in your car. Some valets shut off your automatic headlights when parking the vehicle.
4. Stay aware of your alcohol consumption. It’s smart to drink a glass of water in between alcoholic beverages. Eating alcohol-absorbing foods is also wise.
5. If you have been drinking, avoid using your cell phone while driving. Just one swerve is enough to prompt the police to pull you over.
6. Areas and streets such as Mid-Town, Washington, Montrose, Westheimer, Shepherd and Kirby are bar-laden hot spots. If you think it’s hot, so do the police.

If you are pulled over, remember these five things:
1. Use your right to remain silent. You are being recorded outside and inside the vehicle.
2. Politeness counts. If you choose to speak to the police officer, remember your manners.
3. Refuse all coordination exercises. They are very complex and designed for failure.
4. Every single day is “No Refusal,” which means if you refuse to take a breath test, the police will get a warrant to draw your blood. Both sciences have their problems, but it is a lot easier to beat a breath test. Take the breath test. The Intoxilyzer 5000EN breath test machine is a hunk of junk.
5. If you are in possession of drugs, refuse any searches of your person and/or vehicle.
