Exit Elite Realty Retain Tampa Law Offices of Stamatakis + Thalji + Bonanno to Countersue in Defamation Law Suit Filed by ReMax’s The Duncan Duo
Tampa, Florida (PRWEB) May 05, 2016 -- Exit Elite Realty and broker Jason Garcia retain Tampa law offices of Stamatakis + Thalji + Bonanno to represent them and countersue ReMax’s The Duncan Duo regarding a Facebook post by Garcia which was allegedly defamatory.
On March 17, 2016, ReMax’s Duncan Duo filed a lawsuit in Hillsborough County, Florida against Exit Elite Realty and broker Jason Garcia in Case No.: 2016-CA-002597. Count I of the Complaint is for Defamation by Implication regarding a Facebook post by Garcia. On May 2, 2106, Stamatakis + Thalji + Bonanno filed Exit’s and Garcia’s defenses and a counter law suit against The Duncan Duo, as well as Andrew S. Duncan and Angela C. Duncan personally in the same Case No.: 2016-CA-002597. Among the nine defenses alleged by Exit and Garcia are that any such statements made in regards to The Duncan Duo were either substantially true or matters of personal opinion. The counter law suit seeks certification as a Class Action “. . . consisting of all persons who participated in a successfully funded real estate closing as a licensed real estate agent in either Hillsborough, Pinellas, Pasco, Hernando, Polk, Manatee and/or Sarasota counties from 2012 through 2016.”
The counter law suit alleges a violation of Florida’s Deceptive and Unfair Trade Practices Act by engaging in “. . . . substantial business throughout the entire Tampa Bay region using a series of unregistered, unauthorized and/or illegal fictitious or trade names without first complying with the registration requirements of Florida’s ‘Fictitious Name Act."
