Layfield & Barrett, APC Announces $60 Million Lawsuit Against Deer Valley Resort Company for Skiing Accident in Park City
Park City, UT (PRWEB) July 18, 2016 -- Ed and Penni Bailey, represented by Layfield & Barrett, APC, have filed a lawsuit in Utah’s Third Judicial District Court, Summit County under the Case Name Bailey, et al. v. Deer Valley Resort Company with Case No.160500309. The lawsuit alleges that Deer Valley Resort Company was negligent in its maintenance of a ski run and as a result Ed Bailey suffered a severe traumatic brain injury in a skiing accident at the Deer Valley Resort in Park City, Utah.
According to court documents, on January 22, 2016, while skiing on an intermediate trail at Deer Valley Resort, Ed Bailey, an accomplished finance executive, crashed just below a temporary platform constructed to host competition facilities and spectator amenities at the upcoming 2016 FIS Freestyle Ski World Cup. The lawsuit alleges that, in constructing the platform, Deer Valley Resort reshaped a normally wide and gradual run-out area and turned a normally gentle break at the downhill end of the platform into a steep drop. The complaint filed in the case alleges that Deer Valley Resort had effectively created a large blind jump overnight, and as a result Bailey, who had skied the same run the previous day before Deer Valley made the changes, was caught by surprise and crashed.
“It is my clients’ contention in the lawsuit that Deer Valley Resort Company had an obligation to adequately warn skiers of the new, sudden drop the company created with the overnight changes,” said Philip Layfield, attorney for the Baileys. “We allege in the complaint that Deer Valley Resort did not provide an adequate warning to skiers such as Ed and that the Resort did not properly rope off the area or put up signs until after Ed’s crash. We offered to resolve this matter out of court and Deer Valley has refused. Now it’s time to obtain full and fair compensation for this event.”
In the complaint filed against Deer Valley Resort Company, the Baileys allege that Ed Bailey sustained a severe traumatic brain injury resulting in post-traumatic amnesia, cognitive impairment, personality changes, and other severe effects from the crash that will require medical treatment and physical therapy into the future. The lawsuit alleges that up until the crash at Deer Valley Resort, Ed Bailey had been a leader in his church and a highly successful managing director of his finance company in Salt Lake City. The lawsuit also alleges that Bailey has lost most of his earnings and has been forced to withdraw from many of the activities in which he had previously engaged.
