The Complaint alleges that Advanced Medical Personnel Services, Inc., and Rise Medical Staffing, LLC failed and continues to fail to accurately calculate and pay PLAINTIFF and the other members of the CALIFORNIA CLASS for their overtime worked. State law provides that employees must be paid overtime at one-and-one-half times their “regular rate of pay.”
The pending class action lawsuit against both Advanced Medical Personnel Services, Inc., and Rise Medical Staffing, LLC , alleges that the companies failed to have a policy or practice which provided a full off-duty, thirty minute uninterrupted meal break to their California non-exempt employees. Consequently, employees working for the California companies allegedly forfeited meal and rest breaks without additional compensation.
