In 2010, the SEC amended Custody Rule 206(4)-2 under the Investment Advisors Act of 1940 to require more transparency and reporting requirements by fund managers and Registered Investment Advisors (RIAs.) As a result of the new regulatory environment, Private Fund Custody was introduced as a cost-effective way to comply with the SEC’s new rule.

As a qualified custodian, Midland Trust Company opens accounts at the fund level to hold cash and alternative assets while processing transactions in and out of the fund.
