What Attorneys Really Think About Expert Witnesses Revealed in ExpertPages® Groundbreaking New Report
SAUSALITO, Calif. (PRWEB) July 18, 2018 -- With litigation of all types becoming increasingly complex and high-stakes, the demand by attorneys for highly qualified and credentialed expert witnesses has grown exponentially. Yet little was known about the issues confronting attorneys as they search for their so-called, “Perfect Expert.”
To answer some of these important questions – from the perspective of attorneys – we asked attorneys who are actively involved on a day-to-day basis with selecting, retaining and working with expert witnesses and received more than 200 completed questionnaires.
Among the key findings of the comprehensive Report are:
• Reducing/Eliminating out-of-pocket expenditures, and overbilling in general, topped the list of the most common problems.
• Word of Mouth and Online Search/Directories were the preferred search tools for half (51%) of respondents.
• Daubert/Frye Challenges are quite frequent, with almost two out of three (64%) of Attorneys experiencing them in the past few years.
• Qualifications of the Expert and Lack of Valid Data used by the expert were the most frequent bases of challenges.
• More than seven in ten (74%) attorneys find it necessary to ask their experts to reconsider, revise or expand on, their draft reports.
“This Report is the most comprehensive examination of the complex relationship that exists between trial attorneys and expert witnesses,” said Gerry H. Goldsholle, Founder of ExpertPages and author of the reports. “When we began ExpertPages.com more than 20 years ago expert witnessing was a cottage industry, in which a relatively small circle of experts primarily generated assignments by word of mouth.”
“Today with automation, robotics and artificial intelligence making some formerly mundane tasks simpler and others increasingly complex, the need for experts to unravel the intricacies and provide clear opinions in laymen's terms for judges, juries and arbitrators [the trier of fact] is more important than ever. Finding those ‘perfect’ experts, and working effectively and efficiently with them is the challenge. This report helps identify the issues that can build a better working relationship between the attorney and the expert.”
The 27-Page Report is available for free download in PDF format, for qualified attorneys and experts, at Link. The full Survey Report will be available for purchase on Amazon.com in the next few weeks.
