NRCT, LLC, a Successful Opponent in a Court Case, Announces that MORGAN & MORGAN, P.A. Partner Gets Hit With Sanctions For Improper Litigation Tactics
A Bankruptcy Judge sitting in the United States District Court in the Northern District of Georgia has sanctioned Morgan & Morgan, P.A. partner, Clay M. Townsend based on improper litigation tactics stemming from a failed effort to impose like sanctions on NRCT's manager, Chittranjan K. Thakkar.
MIAMI, Dec. 17, 2022 /PRNewswire-PRWeb/ -- NRCT, LLC, an Atlanta-based commercial real estate developer, announced today that a Bankruptcy Judge sitting in the United States Bankruptcy Court for the Northern District of Georgia has imposed sanctions on Morgan & Morgan, P.A. partner, Clay M. Townsend based on improper litigation tactics stemming from a failed effort to impose like sanctions on NRCT's manager, Chittranjan K. Thakkar. In a six-page decision entered by Judge Wendy L. Hagenau in Good Gateway, LLC v. NRCT, LLC (Case No. 19-05284) on November 17, 2022, the Judge found that "Mr. Townsend violated Bankruptcy Rule 9011 by filing the Motion for Sanctions" against Mr. Thakkar.
By order dated November 1, 2022 in the above case, Judge Hagenau ordered Townsend to personally appear before the bankruptcy judge and show cause why he should not be sanctioned for violating rules that prohibit lawyers from engaging in ill-advised litigation tactics. On November 16, 2022, that show cause hearing was conducted in Atlanta, Georgia. In Judge Hagenau's written decision on November 17, 2022 following that hearing, Judge Hagenua found that bankruptcy rules require an attorney to certify that a written motion is not being presented for any improper purpose and the legal contentions in the motion are warranted. The Judge remarked during the hearing that the plain language of Bankruptcy Rule 9011 indicates that Mr. Townsend's efforts to impose sanctions on Mr. Thakkar was nothing more than a personal vendetta and found in her November 17, 2022 decision that Townsend's request for sanctions against Mr. Thakkar were procedurally improper for several reasons. Not only was Mr. Townsend's filing procedurally improper, but the judge found that Mr. Thakkar could not be sanctioned since he wasn't even a party to the bankruptcy case.
