Andrews International Offers Continuing Legal Education

The course focuses on the e-discovery benefits and challenges associated with cloud-based electronically stored information (ESI). Potentially of interest not only to legal practitioners but also to any business considering migration to the cloud, the course explores related security risks and considerations with the insights of digital forensics and litigation support experts from Andrews International, an affiliate of U.S. Security Associates.
According to Jesus F. Peña, CCFT, AI’s Director of Digital Forensics, the cloud has transformed the way litigators and their support staff deal with e-discovery. There has been a surge in the use of mobile apps, online collaboration tools, and cross-platform solutions to solve real law firm business challenges. Although cloud computing solutions have been available for years and are becoming more widely used in the legal industry, they are not fully understood by many attorneys. Questions exist around the technology itself, the ethical opinions, the professional responsibility for attorneys, and the terms and conditions for using the solutions as they pertain to the security and protection of client-privileged data.
Peña points to recent legal decisions that demonstrate the increasing importance of technical competence when dealing with cloud-based ESI. For example, in the case of Brown v. Tellermate Holdings (2014) relevant cloud-stored data/evidence was precluded from admission because attorneys in the case were unfamiliar with e-discovery procedures and the technical details of the client’s cloud storage.
AI’s new course, The Cloud: e-Discovery Challenges, Benefits, and Migration Tips, covers e-discovery-related federal rules of evidence, the identification, preservation, and collection phases of recovering and investigating cloud-based ESI, and possible issues when implementing litigation holds. It also highlights advantages that cloud-based ESI has over on-premise ESI and other considerations relative to migrating to the cloud.
Peña comments, “Just as seasoned lawyers and judges were becoming comfortable with the on-premise ESI model and nomenclature, along comes this thing called the cloud, adding yet another level of complexity and players - the data-hosting companies. I think course attendees may be surprised when they learn the different types of data that now reside in the cloud.”
