Attorney Alex Galindo with Curd, Galindo & Smith, LLP announces that John Ravera, DDS and Amy Ravera seek $60,000,000 in damages against the County of San Diego for allegedly maintaining a dangerous roadway near Borrego Springs which caused Dr. Ravera traumatic brain injuries.
SAN DIEGO, Oct. 7, 2021 /PRNewswire-PRWeb/ -- Attorney Alex Galindo with Curd, Galindo & Smith, LLP, Trial Lawyers, announces that he has filed a lawsuit against the County of San Diego and David Beakel on behalf of his clients, John Ravera, DDS and Amy Ravera. The Raveras are seeking $60,000,000 in monetary damages.
The lawsuit filed in the Superior Court of San Diego County, Case No.: 37-2021-00021117 alleges that on March 20, 2020, John Ravera was riding his motorcycle with a friend heading east on Borrego Salton Seaway. Dr Ravera was riding his motorcycle in the eastbound lane approaching a drop in the Borrego Salton Seaway near a flood zone known as Fonts Point. The complaint further alleges that at the bottom of the rise defendant David Beakel made a U-turn. The court record alleges that Dr. Ravera, due to the rise and drop of the roadway and no warning signs, Dr. Ravera could not see defendant David Beakel making the U turn at the bottom of the roadway. The court records allege that the rise and drop of the roadway coupled with the County of San Diego's failure to warn created a "Hidden-Trap". As Defendant David Beakel made the U turn, Dr. Ravera attempted to brake but impacted with the Ford Escape driven by David Beakel.
The court documents allege that due to the Hidden-Trap and other maintenance failures, the roadway was in an allegedly dangerous and defective condition such that a motorcyclist could not properly brake due to sand, dirt and soil on the roadway and could not have noticed the vehicle approaching westbound making a U-turn. The lawsuit alleges that the County of San Diego failed to properly maintain the roadway and that it failed to remove debris and dirt on the roadway from the flooding which prevented the proper braking of the Plaintiff's motorcycle.
The court records allege that eastbound vehicles traveling along Borrego Salton Seaway at the area of impact have no warning that a motorist could be making a U-turn at the drop of the roadway and the failure to keep the roadway free of dirt and debris created a defective and unsafe roadway.
The court documents allege that Dr. Ravera suffered a traumatic brain injury that has prevented him from returning to his dental practice.
