FRAMINGHAM, Mass., Feb. 20, 2019 /PRNewswire-PRWeb/ -- Attorney Brian Simoneau, a recognized expert on Massachusetts Motor Vehicle Law and Procedures, has successfully overturned a license suspension triggered by unlicensed operation of a motor vehicle. The docket number for this case is 25010.
Attorney Simoneau's client is a successful businessman who was caught driving on an expired driver's license and given a citation. He immediately renewed his license and the criminal unlicensed operation charge was converted to a civil infraction in the Attleboro District Court. The unsuspecting motorist paid a $100.00 fine and he thought that his payment would end the matter.
A few days after his court appearance, he received a letter from the Massachusetts Registry of Motor Vehicles notifying him that the Registry would suspend his driver's license for 60 days due to his driving on an expired license. He had never been arrested and his driving record was very clean.
Attorney Simoneau challenged the suspension at the Driver Control Unit of the Registry of Motor Vehicles and the RMV ultimately refused to reinstate his client's driver's license. The Registry took the position that the suspension was valid and it would not be terminated or reversed. The motorist would have to serve the 60-day license loss and pay the required reinstatement fee.
Ultimately, Attorney Simoneau brought the case before the Board of Appeal of the Massachusetts Division of Insurance. This appellate board has broad powers to review and reverse Registry actions. It also has the authority to order the Registry to grant hardship licenses and full reinstatements to deserving appellants.
After considering Attorney Simoneau's detailed and compelling memorandum, and hearing arguments from both Simoneau and the Registry's lawyer, the Board of Appeal agreed with Attorney Simoneau and the members ruled that the license loss should not have been imposed. The Board members voted to annul the suspension. This annulment allowed the client to immediately reinstate his driver's license without the payment of a reinstatement fee. The Registry will also remove the suspension from the motorist's driving record.
