Attorney Anthony Fantauzzi Champions Small Business Owner in Case Against BP
Tampa, FL (PRWEB) July 28, 2015 -- Attorney Anthony Fantauzzi, who specializes in business litigation, recently filed a case (No. 15-003892-CI, Pinellas County/6th Judicial Circuit, Florida) against British Petroleum (BP) on behalf of Lisa’s Café of Madeira Beach. According to the court documents, Lisa Ammons, owner of the Gulf Coast café, alleges that as a result of the Gulf of Mexico April 20, 2010, Deepwater Horizon disaster, aka the “BP oil spill,” and considered the largest accidental marine oil spill in the history of the petroleum industry, her business was catastrophically affected.
According to the court documents, this Gulf Coast beachside restaurant that features local and fresh-catch seafood, Lisa’s Café was undoubtedly affected by the oil spill. The restaurant lost revenues from the tourism traffic avoiding Florida’s Gulf Coast beaches that were inundated with oil while its food costs soared. In addition to the higher seafood costs, its customer base dwindled as the quality and availability of the seafood needed for its menu declined.
As a result of the spill, BP created the Deepwater Horizon Economic and Property Damages Settlement Program to provide “swift compensation” to the Gulf Coast businesses impacted by this disaster. In particular, the program was geared toward businesses dependent upon tourism and the Gulf Coast seafood industry, such as Lisa’s Café, which filed a claim with BP for damages associated with business losses, incurred as a result of the oil spill. According to the court documents, after offering $123,858 in compensation to Lisa’s Cafe, BP allegedly reneged on its settlement and rescinded its offer for procedural reasons.
In response to this, Ammons and Fantauzzi filed a new case (No. 15-003892-CI, Pinellas County/6th Judicial Circuit, Florida) separate from the class-action lawsuit and are suing BP for breach of contract, fraud and negligent training of staff. The latter claim, according to the court documents, stems from Ammons’ reported communication with BP representatives regarding the “opt out” status of her claim. Ammons was allegedly unaware of what that status was or what it meant. Furthermore, according to the lawsuit's documents, a representative “even admitted to their mistake” and stated they should not have even been speaking with Ammons.
