Attorney Ian Friedman Shares Valuable Insight with Channel 3 News
(PRWEB) November 25, 2014 -- Although trial juries and grand juries are spoken of often in the legal world, many people are still unsure of the differences between the two and what purposes they serve. Attorney Ian Friedman addressed this confusion recently on Channel 3 News.
The biggest difference between the two is that trial juries are available to the public, while grand juries are much more private and secretive. The defense team has to be invited by the prosecutor in order to attend.
Trial juries, therefore, exist to prove an individual either guilty or innocent. The proof must be beyond reasonable doubt, which Attorney Friedman referred to as the highest standard in the land in his recent interview. The defense lawyers and prosecution team come together to present their arguments toward the defendant’s outcome.
The ultimate goal of a grand jury is to present enough evidence to establish probable cause. Such a jury usually consists of 14-23 people but in Cuyahoga County, the standard is typically 14. Again, the prosecutors are the only ones presenting evidence at a grand jury – the defense team is not actively involved.
Because of the news circling regarding the Ferguson, MO case, Channel 3 News asked Attorney Friedman about grand juries in these type of high profile cases. Attorney Friedman agreed that in Ferguson particularly, there is a push by the community to get a decision. They want an answer, and they want an answer now.
This is not, he commented, always the best way to go about a grand jury decision. Attorney Friedman believes that the case needs its time and will need to have sufficient evidence gathered in order to make the right decision or ruling. Attorney Friedman further stated that with such a weighty decision to be made, it should not come out of intimidation or pressure from the public.
