The case was filed in Superior Court of California, County of Santa Clara, Case No. 18 CV321503. According to court documents, the plaintiff was crossing Highway 280 with the pedestrian "walk" signal on when the defendant, who was trying to turn right, hit her. The defendant was cited by the police for violation of Vehicle Code Section 21950(a) for failure to yield to pedestrians.
Court documents further state that because of the accident, the plaintiff sustained permanent loss of smell and traumatic brain injury, as well as psychological and emotional injuries. Court documents also state that she has not been able to work since the accident.
