SAS Retail Services, LLC allegedly failed to reimburse employees for required business expenses. California Labor Code §2802 expressly states that "an employer shall indemnify his or her employee for all necessary expenditures or losses incurred by the employee in direct consequence of the discharge of his or her duties..." During employment, Plaintiff and other California Class Members were allegedly required to use their personal cellular phones, personal vehicles and personal home offices as a result of and in furtherance of their job duties.
Additionally, the lawsuit alleges Defendant underpaid minimum and overtime wages to Plaintiff and other California Class Members by failing to pay such wages at the regular rate of pay. Plaintiff received a non-discretionary bonus that was allegedly not calculated into the regular rate of pay, which resulted in an alleged underpayment of minimum and overtime wages. Allegedly, the incentive program was described to potential and new employees as part of the compensation package.
