According to the lawsuit filed in the Riverside Superior Court, The Ameriprise Auto & Home Insurance Agency, Inc., allegedly failed to provide their employees with meal and rest breaks because allegedly Ameriprise Auto & Home Insurance Agency, Inc., did not have a policy to provide their hourly employees thirty (30) minute uninterrupted meal breaks prior to their fifth (5th) hour of work. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee's fifth (5th) hour of work.
Additionally, the complaint further alleges The Ameriprise Auto & Home Insurance Agency, Inc., committed acts of unfair competition in violation of the California Unfair Competition Law, Cal. Bus. & Prof. Code §§ 17200, et seq. (the "UCL"), by engaging in a company-wide policy and procedure which failed to accurately calculate and record all missed meal and rest periods by PLAINTIFFS and other CALIFORNIA CLASS Members. As a result of DEFENDANT's intentional disregard of the obligation to meet this burden, DEFENDANT allegedly failed to properly calculate and/or pay all required compensation for work performed by the members of the CALIFORNIA CLASS and violated the California Labor Code.
