According to the lawsuit filed in the Los Angeles Superior Court, Asendia USA, Inc. allegedly failed to provide PLAINTIFF accurate itemized wage statements. DEFENDANT allegedly from time to time violated Cal. Lab. Code § 226 by failing to provide wage statements that identified the correct gross wages earned. Cal. Lab. Code § 226 provides that "every employer shall furnish each of his or her employees with an accurate itemized wage statement in writing showing, among other things, gross wages earned and all applicable hourly rates in effect during the pay period and the corresponding amount of time worked at each hourly rate."
Additionally, the complaint further alleges Asendia USA, Inc., committed acts of unfair competition in violation of the California Unfair Competition Law, Cal. Bus. & Prof. Code §§ 17200, et seq. (the "UCL"), by engaging in a company-wide policy and procedure which failed to accurately calculate and record the correct overtime rate for the overtime worked by PLAINTIFFS and other CALIFORNIA CLASS Members. As a result of DEFENDANT's intentional disregard of the obligation to meet this burden, DEFENDANT allegedly failed to properly calculate and/or pay all required overtime compensation for work performed by the members of the CALIFORNIA CLASS and violated the California Labor Code.
