Allegedly, PLAINTIFF and other CALIFORNIA CLASS Members were from time to time unable to take off-duty meal breaks and were not fully relieved of duty for meal periods. They were also from time to time allegedly required to work in excess of four (4) hours without being provided ten (10) minute rest periods.
Additionally, DEFENDANT intentionally and knowingly failed to reimburse and indemnify PLAINTIFF and the other CALIFORNIA CLASS Members for required business expenses incurred by the PLAINTIFF and other CALIFORNIA CLASS Members. Cal. Lab. Code § 2802 expressly states that "an employer shall indemnify his or her employee for all necessary expenditures or losses incurred by the employee in direct consequence of the discharge of his or her duties..."
