Blumenthal Nordrehaug Bhowmik De Blouw LLP, File Lawsuit Against Loyal Source Government Services LLC for Alleging Violations of The Private Attorneys General Act (PAGA)
The lawsuit alleges Loyal Source Government Services LLC, violated the California Labor Code by failing to provide their employees with required meal and rest periods and allegedly failed to pay overtime.
SAN DIEGO, June 12, 2020 /PRNewswire-PRWeb/ -- The San Diego employment law attorneys at Blumenthal Nordrehaug Bhowmik De Blouw LLP, filed a class action complaint alleging that Loyal Source Government Services LLC violated The Private Attorney General Act and allegedly failed to lawfully calculate and pay their employees the correct overtime. The Loyal Source Government Services LLC class action lawsuit, Case No. 37-2020-00015529-CU-OE-CTL, is currently pending in the San Diego County Superior Court for the State of California. A copy of the Complaint can be read here.
According to the lawsuit filed in the San Diego Superior Court, Loyal Source Government Services LLC allegedly failed to provide their employees with meal and rest breaks because the company, allegedly, did not have a policy to provide their hourly employees thirty (30) minute uninterrupted meal breaks prior to their fifth (5th) hour of work. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee's fifth (5th) hour of work.
PAGA is a mechanism by which the State of California itself can enforce state labor laws through the employee suing under the PAGA who do so as the proxy or agent of the state's labor law enforcement agencies. An action to recover civil penalties under PAGA is fundamentally a law enforcement action designed to protect the public and not to benefit private parties. The purpose of PAGA is not to recover damages or restitution, but to create a means of "deputizing" citizens as private attorneys general to enforce the Labor Code.
