The class action lawsuit alleges McGee Air Services, Inc. failed to pay their employees the correct amount of overtime wages and further alleges that the company failed to provide meal and rest breaks to their employees.

Furthermore, the complaint alleges that McGee Air Services, Inc., failed to provide mandatory meal and rest breaks to their employees. The class action complaint alleges that McGee Air Services, Inc., failed to accurately pay PLAINTIFF and other members of the CALIFORNIA LABOR SUB-CLASS overtime wages for the time they worked which was in excess of the maximum hours permissible by law as required by Cal. Lab. Code §§ 510, 1194 & 1198. Cal. Lab. Code § 510 further provides that employees in California shall not be employed more than eight (8) hours per workday and/or more than forty (40) hours per workweek unless they receive additional compensation beyond their regular wages in amounts specified by law.
According to the class action complaint, the company's non-exempt employees were also allegedly unable to take off duty meal breaks due to their rigorous work schedules. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee's fifth (5th) hour of work. The complaint alleges that the company did not provide their employees who forfeited meal breaks additional compensation.
