ARLINGTON, Texas, September 27, 2019 /PRNewswire-PRWeb/ -- In two recent articles published in the Fort Worth Star-Telegram, one by Mitch Mitchell, the second two days later by Anna M. Tinsley, the issue of the legality of selling and using CBD oil in Texas was addressed. The primary issue is about whether CBD oil may be interpreted as legal, based on its level of THC.
According to CBD American Shaman of DFW franchisee Randy Lierz, "Some people formulate it the wrong way, where it contains too high of a level of THC. Our CBD oil, which is made from the industrial hemp plant, not marijuana, has below .3% of the 'psychoactive' ingredient THC. Our CBD oil is made from the hemp plant, not the marijuana plant, although they are related. Nothing we sell will get you high. Some lawmakers understand that CBD oil allows a patient the benefits without the high. Decaffeinated coffee still has a miniscule amount of caffeine left in it."
Federal and state laws surrounding marijuana and hemp products are confusing and change regularly. Law enforcement officials, according to some Texas criminal attorneys, are encouraging legislators to clarify the rules.
According to the Texas Legislature Online, State Rep. Terry Canales, D-Edinburg, authored and filed HB551 in February 2019 to address some of the legal questions encompassing marijuana extracts.
Commissioner of the Food and Drug Administration (FDA) Scott Gottlieb attended a special meeting of the National Association of State Departments of Agriculture (NASDA) recently and gave a speech on hemp. Previously, he discussed in December 20, 2018, a regulatory pathway. "Pathways remain available for the FDA to consider whether there are circumstances in which certain cannabis-derived compounds might be permitted in a food or dietary supplement," Gottlieb's statement read. The FDA "has no questions" concerning hulled hemp seed, hemp seed oil and hemp seed powder that it is generally recognized as safe under their intended conditions of use.
"We provide lab reports of all products on our website," Lierz concluded. "You can take a look at them individually and see what you're getting. What you're getting is a product with therapeutic benefits, a product that helps reduce stress and manage pain. We encourage you to contact your senators and congressmen today and let them know you want a clear path to clear legal recognition of all hemp products, including CBD."
