Class Action Lawsuit Alleges Commemorative Coin Sales Violate Multiple Consumer Protection Laws
Attorneys at Dallas' Steckler Wayne Cochran Cherry PLLC on May 4 filed a class action lawsuit on behalf of consumers who purchased commemorative coins from Westminster Mint. One 75-year-old Pennsylvania man purchased $294,000 worth of coins he was told would rise in value, the lawsuit alleges.
DALLAS, May 17, 2021 /PRNewswire-PRWeb/ -- Attorney Bruce Steckler at Dallas' Steckler Wayne Cochran Cherry PLLC on May 4 filed a class action complaint against Westminster Mint, Inc., in U.S. District Court for the District of Minnesota on behalf of consumers who have made a purchase of commemorative coins since 2010 based on allegedly misleading, deceitful sales tactics.
The case is Roger Mierzwa, et al. v. Westminster Mint, Inc., No. 0:21-CV-01157.
The named plaintiff, Roger Mierzwa, of Pennsylvania, was allegedly solicited more than 50 times over the phone and through email correspondence by Westminster Mint. He eventually purchased $294,000 worth of coins, including one coin that cost nearly $3,000. He believed the coins had multiplied in value, and did not discover their true value until 2017, when he attempted to sell the coins to pay for his daughter's wedding.
The complaint alleges that Westminster Mint described these purchases as investments that would grow in value. Mierzwa is representing himself and others similarly situated who allege they purchased coins from Westminster Mint due to the company's marketing practices.
"Our client purchased these coins because he was told they would increase in value, but that was simply false and misleading," said Bruce Steckler, lead counsel for the Plaintiffs.
According to court documents, the lawsuit outlines allegations of negligence, unjust enrichment, violation of the Minnesota Prevention of Consumer Fraud Act, violation of the Minnesota Uniform Deceptive Trade Practices Act, and violation of the Deceptive Acts Perpetrated Against Senior Citizens or Disabled Persons Act.
