Nearly 6,900 DePuy Pinnacle lawsuits (http://www.consumerinjurylawyers.com/depuy-pinnacle/lawsuit) are now contained in the U.S. District Court, Northern District of Texas, where a federal litigation has been established for similar cases against its manufacturer, Bernstein Liebhard LLP reports.
Court documents updated on September 30th show 6,849 lawsuits now filed in the proceeding, on behalf of individuals who accuse DePuy Orthopaedics of failing to warn about the potential for a metal-on-metal version of the Pinnacle hip to fail prematurely, and cause metallosis, chronic pain and other injuries. According to court records, the DePuy Pinnacle litigation moved forward last month with the start of its first federal trial. The trial began on September 3rd, and is continuing to move forward, according to a recent Reuters report that noted the hearing of claims filed by a 58-year old Montana woman who suffered elevated cobalt levels in her blood stream as a result of metal debris from her implant, which caused several other serious complications.* (Herlihy-Paoli v. More than a year before this trial began, Johnson & Johnson and DePuy Orthopaedics announced that they would stop selling the all-metal version of the Pinnacle, as well as other metal-on-metal implants, for commercial, rather than safety reasons.**The announcement followed an alert from the U.S. Food and Drug Administration (FDA) in January 2013 that metal-on-metal hips were more likely to fail early than any other type.
