DePuy Pinnacle Lawsuits Surpass 6,800 in Federal Texas Litigation, as Trial Continues to Move Forward, Bernstein Liebhard LLP Reports
New York, NY (PRWEB) October 05, 2014 -- Nearly 6,900 DePuy Pinnacle lawsuits (http://www.consumerinjurylawyers.com/depuy-pinnacle/lawsuit) are now contained in the U.S. District Court, Northern District of Texas, where a federal litigation has been established for similar cases against its manufacturer, Bernstein Liebhard LLP reports.
Court documents updated on September 30th show 6,849 lawsuits now filed in the proceeding, on behalf of individuals who accuse DePuy Orthopaedics of failing to warn about the potential for a metal-on-metal version of the Pinnacle hip to fail prematurely, and cause metallosis, chronic pain and other injuries. Plaintiffs in these cases allege that the metal-on-metal version of the device was designed defectively. (In re: DePuy Orthopaedics Inc. Pinnacle Hip Implant Product Liability Litigation, MDL No. 2244)
“We are not surprised to see the number of DePuy Pinnacle hip lawsuits continuing to grow in Texas federal court, as our Firm’s attorneys hear on a regular basis from individuals who were injured by the metal-on-metal device,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm continues to evaluate potential lawsuits on behalf of individuals who were allegedly harmed by the metal-on-metal Pinnacle Hip Replacement System.
DePuy Pinnacle Hip Replacement Litigation
According to court records, the DePuy Pinnacle litigation moved forward last month with the start of its first federal trial. The trial began on September 3rd, and is continuing to move forward, according to a recent Reuters report that noted the hearing of claims filed by a 58-year old Montana woman who suffered elevated cobalt levels in her blood stream as a result of metal debris from her implant, which caused several other serious complications.* (Herlihy-Paoli v. DePuy Orthopaedics Inc., 11-cv-3590)
More than a year before this trial began, Johnson & Johnson and DePuy Orthopaedics announced that they would stop selling the all-metal version of the Pinnacle, as well as other metal-on-metal implants, for commercial, rather than safety reasons.**The announcement followed an alert from the U.S. Food and Drug Administration (FDA) in January 2013 that metal-on-metal hips were more likely to fail early than any other type.
Alleged victims of DePuy Pinnacle hip complications may be entitled to compensation for injury-related damages. Learn more about filing a DePuy Pinnacle lawsuit by visiting Bernstein Liebhard LLP’s website. For a free and confidential evaluation of your case, call 800-511-5092 today.
