DePuy Pinnacle Hip Lawsuits: Federal Litigation Amends Case Management Order to Allow for Joinder of Unrelated Claims
New York, New York (PRWEB) April 18, 2015 -- Thousand of DePuy Pinnacle hip lawsuits (http://www.consumerinjurylawyers.com/depuy-pinnacle/lawsuit) filed on behalf of individuals who were allegedly harmed by a metal-on-metal version of the hip replacement system continue to move forward in the U.S. District Court, Northern District of Texas. According to an Order dated April 10th, the Court has amended an earlier Case Management Order to allow for the joinder of unrelated cases. Among other things, the new amendment permits the claims of up to 150 plaintiffs to be combined in a single complaint. (In re: DePuy Orthopaedics Inc. Pinnacle Hip Implant Product Liability Litigation, MDL No. 2244)
“This amendment will allow DePuy Pinnacle hip lawsuits pending in the federal litigation to proceed more efficiently. Our Firm is representing hundreds of plaintiffs in this proceeding, and we are pleased with the continued progress of these cases. Our legal staff will continue to closely monitor developments relevant to our clients’ claims,” says Sandy A. Liebhard, a partner with Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm continues to offer free legal evaluations to individuals who were allegedly harmed by the all-metal Pinnacle hip device.
DePuy Pinnacle Hip Allegations
According to court documents, the DePuy Pinnacle hip litigation was established in May 2011. As of April 1st, more than 7,000 cases were pending in the proceeding, all of which involve a metal-on-metal version of the DePuy Orthpaedics’ Pinnacle Hip Replacement System that utilizes the Ultimate liner, which allegedly has a propensity to shed dangerous amounts of toxic metal debris. Plaintiffs claim that this occurrence places recipients at risk for metallosis, chronic pain, premature device failure and other complications that may necessitate revision surgery to remove and replace the device.
Court records indicate that the litigation is currently in the process of selecting a Pinnacle lawsuit for its second bellwether trial. The first trial concluded in last October with a verdict for the defense. (Case No. 11-cv-3590)
Alleged victims of metallosis, pseudotumor formation, and other complications related to the metal-on-metal version of the DePuy Pinnacle hip replacement may be entitled to compensation for medical bills, lost wages and other damages.
