The Activcare Living, Inc. class action lawsuit, Case No. 37-2022-00000862-CU-OE-CTL, is currently pending in the San Diego County Superior Court of the State of California. The complaint alleges Activcare Living, Inc. failed to provide employees with compensation for overtime worked. Defendant required Plaintiff and California Class Members to work during what was suppose to be off-duty meal breaks. Additionally, Plaintiff was from time to time interrupted by work assignments while clocked out. State and federal law provides that employees must be paid overtime and meal and rest break premiums at one-and-one-half times their "regular rate of pay."
California Labor Code § 226 states that employers shall provide employees with accurate itemized wage statements showing, among other things "gross wages earned and all applicable hourly rates in effect during the pay period..." The lawsuit alleges that Defendant allegedly violated this California Labor Code by allegedly failing to provide accurate itemized wage statements.
