According to the lawsuit filed, employees were required to undergo mandatory temperature checks, as a part of Covid-19 screening. Allegedly, Nichols Pistachio failed to record and pay employees for the time spent waiting in line and submitting to the screening. Additionally, Plaintiff was allegedly, from time to time, required by Defendant to work during what should have been Plaintiff's off-duty meal break.
California Labor Code § 226 provides that every employer shall provide employees with an accurate itemized wage statement in writing showing, among other things, gross wages earned. Allegedly, Defendant failed to provide wage statements that identified the correct gross and net wages earned.
