Gillware Digital Forensics Assists in $66 Million IP Theft Verdict

MADISON, Wisc., Aug. 22, 2018 /PRNewswire-PRWeb/ -- On August 10, 2018, Lumileds LLC, a San Jose-based manufacturer of high-power LED lights, won a jury verdict of liability for $66 million in damages against Elec-Tech International Co., Ltd. (ETI) in the Superior Court of the State of California (Santa Clara County, CA 2015-1-CV-278566). ETI, a Chinese competitor, was alleged to have stolen trade secrets relating to Lumileds' core technology. The defendants, including Donglei Wang, the CEO of ETI, and Dr. Gangyi Chen, a scientist formerly employed by Lumileds and currently employed by ETI, were found liable for damages in intellectual property theft.

Chen, who had worked at Lumileds from 2005 to 2012, was found to have misappropriated trade secrets from Lumileds and supplied them to ETI. Four months before quitting Lumileds, Chen was offered a substantial payment by Wang and soon moved back to China, bringing the trade secrets with him to ETI and earning a significant career boost as a result. The $66 million awarded to the plaintiffs is the amount of research and development costs ETI was concluded to have saved in its subterfuge.

This case was originally brought to a California federal court as a federal Computer Fraud and Abuse Act (CFAA) claim. However, in 2015 the Court dismissed the CFAA claim, since the incident of trade secret misappropriation did not fall under the narrow confines of the CFAA.
