Pursuant to Internal Revenue Code Section 514(c)(9), the Unrelated Business Income Tax (UBTI) would not apply when using nonrecourse leverage as part of a Solo 401(k) real estate transaction. In other words, real estate investors can buy more real estate with their retirement funds with the hopes of generating a greater amount if tax-free income and gains."
