According to the lawsuit filed, Suncrest Hospice San Jose, LLC allegedly failed to reasonably accommodate PLAINTIFF for her physical disabilities. The injury described in the complaint would qualify as a physical disability, as defined under Cal. Gov. Code §§ 12926(j) and 12926(m). DEFENDANT's termination of PLAINTIFF was allegedly in retaliation.
Additionally, Cal. Lab. Code § 226 provides "that every employer shall furnish each of his or her employees with an accurate itemized wage statement in writing showing...the corresponding amount of time worked at each hourly rate." From time to time, DEFENDANT allegedly failed to provide wage statements to employees that identified the correct gross and net wages earned, which resulted in DEFENDANT allegedly violating Cal. Lab. Code § 226.
