According to the lawsuit filed, West Publishing Corporation allegedly failed to reimburse employees for required business expenses. California Labor Code § 2802 expressly states that "an employer shall indemnify his or her employee for all necessary expenditures or losses incurred by the employee in direct consequence of the discharge of his or her duties..." During employment, Plaintiffs and other California Class Members were allegedly required to use their personal cellular phones in order to complete their job duties.
Additionally, the lawsuit alleges Defendant failed to pay accrued vacation and sick pay wages. Defendant allegedly instituted a "use it or lose it policy" regarding earned vacation hours. Upon termination of employment, Defendant allegedly failed to pay Plaintiffs the total amount of vacation pay due to them.
