According to the lawsuit filed, Res-Care California, Inc. allegedly (a) failed to pay overtime wages, (b) failed to provide legally required meal and rest periods, (c) failed to provide accurate itemized wage statements, (d) failed to reimburse employees for required business expenses, and (e) violated the Private Attorneys General Act, all in violation of the applicable Labor Code sections listed in Labor Code Sections §§ 226, 226.7, 510, 512, 1194, 1198, 2698, 2802 and the applicable Wage Order(s), and thereby gives rise to civil penalties as a result of such alleged conduct.

The complaint further alleges Res-Care California, Inc. committed acts of unfair competition in violation of the California Unfair Competition Law, Cal. Bus. & Prof. Code §§ 17200, et seq. (the “UCL”), by engaging in a company-wide policy and procedure which failed to properly classify PLAINTIFF and others and thereby allegedly failed to pay them overtime wages for documented overtime hours worked. As a result of DEFENDANT’s alleged intentional disregard of the obligation to meet this burden, DEFENDANT allegedly violated the California Labor Code and regulations.
