The lawsuit filed against Spencer Construction LLC alleges PLAINTIFF and other CALIFORNIA CLASS Members were from time to time unable to take thirty (30) minute off-duty meal breaks and were not fully relieved of duty for their meal periods. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee's fifth (5th) hour of work.

Additionally, DEFENDANT allegedly failed to respond and provide PLAINTIFF with his employment file. This resulted in an alleged violation of Cal. Lab. Code Section 1198.5, which states that employees have the right to inspect personnel records maintained by the employer. PLAINTIFF requested his employment file twice, both of which received no response.
