The complaint alleges 7 Eleven, Inc. failed to compensate employees for all the time they were under DEFENDANT's control. Employees were from time to time interrupted by work assignments during meal or rest periods. DEFENDANT knew or should have known that PLAINTIFF and other CALIFORNIA CLASS Members were working off the clock and were not being paid their correct minimum wage and overtime compensation.
Additionally, the lawsuit alleges wrongful termination by the employer, in violation of public policy and violation of the California Labor Code for alleged failure to provide seating. Employees spend the vast majority of their working time behind counters, which can reasonably be accomplished while using a seat/stool. In violation of the applicable sections of the California Labor Code and the requirements of the applicable Industrial Welfare Commission ("IWC") Wage Order, DEFENDANT allegedly knowingly failed to provide suitable seating accommodations.
