According to the lawsuit filed, 4 Gen Logistics, L.L.C. allegedly failed to reimburse employees for required business expenses. California Labor Code § 2802 expressly states that "an employer shall indemnify his or her employee for all necessary expenditures or losses incurred by the employee in direct consequence of the discharge of his or her duties..." During employment, Plaintiffs and other California Class Members were allegedly required to use their personal cellular phones in order to complete their job duties.
Additionally, the lawsuit alleges 4 Gen Logistics, L.L.C. failed to pay employees minimum wages for compensable time worked. Employees are entitled to be paid minimum wages and provided meal and rest periods as required by California law. Plaintiff was also not allegedly provided accurate wage statements, in part due to the alleged underpayment of wages.
