The lawsuit filed against C&J Well Services, Inc. alleges PLAINTIFFS and other CALIFORNIA CLASS Members were from time to time unable to take thirty (30) minute off-duty meal breaks and were not fully relieved of duty for their meal periods. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee's fifth (5th) hour of work.
The lawsuit also alleges that PLAINTIFFS and other CALIFORNIA CLASS Members forfeited minimum and overtime wages by working without their time being accurately recorded. State and federal law provides that employees must be paid overtime at one-and-one-half times their "regular rate of pay." Additionally, it's alleged that DEFENDANT failed to reimburse employees for required business expenses incurred in direct consequence of discharging their duties on behalf of DEFENDANT.
