The lawsuit alleges that PLAINTIFFS and other CALIFORNIA CLASS Members forfeited minimum and overtime wages by working without their time being accurately recorded. Employees were from time to time unable to take required off-duty meal or rest breaks. Allegedly, DEFENDANT required employees to perform work during what was suppose to be off-duty meal breaks, without additional compensation.
Additionally, it's alleged that DEFENDANT failed to reimburse employees for required business expenses incurred in direct consequence of discharging their work related duties. Allegedly, DEFENDANT failed to reimburse or indemnify for the cost associated with the use of their personal cellular phones. Cal. Lab. Code § 2802 expressly states that "an employer shall indemnify his or her employee for all necessary expenditures or losses incurred by the employee..."
