The San Diego employment law attorneys, at Zakay Law Group, APLC and JCL Law Firm, APC, filed a complaint alleging that ASD6 LLC violated the California Labor Code. The ASD6 LLC lawsuit, Case No. 37-2021-00016864-CU-OE-CTL, is currently pending in the San Diego County Superior Court of the State of California. A copy of the Complaint can be read here.

The lawsuit alleges ASD6 LLC violated the Private Attorneys General Act (“PAGA”), which gives rise to civil penalties as a result of ASD6 LLC's conduct. PAGA authorizes aggrieved employees to file a lawsuit to recover civil penalties on behalf of themselves, other employees, and the State of California for Labor Code violations. PAGA allows aggrieved employees to step into the shoes of California state regulators to recover civil penalties, which means ordinary citizens are “deputized” as private attorneys general to enforce the Labor Code.

The complaint alleges ASD6 LLC violated the California Labor Code by failing to: (1) provide compliant meal and rest periods; (2) allow employees to take duty-free, off-the-premises rest periods; (3) pay all minimum, regular and overtime wages; (4) provide accurate itemized wage statements; (5) reimburse employees for required business expenses; and (6) timely pay wages due during, and upon termination of employment.
